Terms of service

Overview

Byron Seven is the trading name of BYRON7 LTD, a company registered in England and Wales under company number 15541975. Our registered office is 5 Canon Court, Institute Street, Bolton, England, BL1 1PZ. In these Terms, “we”, “us” and “our” refer to BYRON7 LTD.

We operate byronseven.net and its related content, tools, products and services (the “Services”). Our store is hosted by Shopify. Purchases are made directly from BYRON7 LTD.

These Terms apply to your use of our store and purchases, together with our Privacy Policy and Return and Refund Policy. Nothing in these Terms excludes or restricts mandatory consumer rights. If a policy conflicts with those rights, applicable law prevails.

1. Access and account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

2. Our products and compatibility

Product pages describe the materials, dimensions, compatibility, features and items included with each product. Devices and accessories shown for demonstration are not included unless expressly listed. Please check the exact device model and product variant before ordering. Contact us if you need help confirming compatibility.

Some products are manufactured using 3D printing. Visible layer lines and minor variations in surface texture or colour may be normal characteristics of this process, where consistent with the product description and satisfactory quality. Screen settings may also affect displayed colours. These characteristics do not excuse defects, incorrect items or products that do not match their description.

Follow the supplied mounting, assembly, care and safety instructions, and check that all fittings are secure before use. Our accessories may be used for personal or professional purposes, subject to their stated intended use and specifications. Third-party brand names identify compatibility and do not imply endorsement or affiliation.

We may update listings or discontinue products for future orders. Changes do not retrospectively alter an accepted order without your agreement, except where permitted by law.

3. Orders, changes and cancellation

By placing an order, you offer to purchase the selected products and authorise payment of the checkout total. An automated receipt acknowledges your order; acceptance occurs when we send an express acceptance or dispatch confirmation. If we decline or cancel an order, we will notify you and promptly refund payments for the cancelled items.

Please check your selection, compatibility and delivery address carefully. Processing may begin promptly, so we do not guarantee that we can accommodate discretionary changes or stop fulfilment after an order is placed. Contact customerservice@byronseven.com immediately with any request.

This operational limitation applies to standard orders and preorders but does not remove any statutory right to cancel or withdraw, including before dispatch where applicable. Exercising a statutory right does not depend on our discretionary approval. Returns and refunds are addressed in section 16 and our Return and Refund Policy.

4. Prices, payment and import charges

The applicable price, currency, discounts, shipping charges and taxes collected by us are shown before you complete checkout and in your order confirmation. Price changes apply to future orders. Any obvious pricing error will be handled under section 12, subject to applicable law.

We arrange and prepay import duties on orders shipped through our delivery arrangements. If a carrier requests an unexpected import-duty payment, contact us before paying so we can investigate. We will not ask you to waive statutory rights concerning undisclosed charges.

You must provide accurate billing and payment information and be authorised to use the selected payment method. Payment processing is provided by the payment services offered at checkout. Separate promotional terms may apply where clearly disclosed before purchase.

5. Production, preorders, shipping and delivery

We use warehouses in Hong Kong and the United Kingdom. The dispatch location is selected according to stock availability and delivery efficiency and may differ between orders.

Products may be ready to ship or made on demand, as described on the product page. Preorders are identified in the product title, with an estimated dispatch date or period provided before purchase. Production and dispatch time are separate from the carrier’s transit time. Refer to the product page and checkout for the estimates applicable to your order.

If an unexpected production or dispatch delay occurs, we will inform you promptly. Such additional delays are generally within one week, but this is an estimate rather than a guaranteed maximum. We will communicate revised estimates and preserve any cancellation or refund rights arising from delay.

Carrier schedules, customs checks and events outside our reasonable control may affect delivery. We will provide reasonable assistance with delayed, missing or damaged shipments. Nothing in these Terms removes our legal delivery obligations. For consumer purchases, risk of loss or damage remains with us until you or your nominated recipient takes physical possession, except where applicable law provides otherwise, such as when you independently commission a carrier not offered by us. Optional shipping protection does not replace or reduce your statutory rights.

6. Intellectual property

Our Services, including but not limited to all trademarks, brands, text, images, graphics, product reviews, video, and audio are owned by Byron Seven, its affiliates or licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. Similarly, the product listings are managed and owned by Byron Seven. The purchase or delivery of any product does not grant or confer any intellectual property rights, including any patent, copyright, trademark, or other proprietary right, in or to the product, its design, software, or underlying technology. All such rights remain exclusively with Byron Seven or the original rights holder. You may browse the store and use the Services to make legitimate personal or business purchases. Buying a product does not restrict its lawful professional use. You may download instructions for using your purchase and share links to our public product pages. Commercial reproduction of our protected content or designs requires permission. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms of Service grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Byron Seven, Shopify or any third party. Unauthorized use of the Services may violate applicable intellectual property or other laws. All rights not expressly granted herein are reserved by Byron Seven. Byron Seven's names, logos, product and service names, designs, and slogans are trademarks of Byron Seven or its affiliates or licensors. You must not use such trademarks without the prior written permission of Byron Seven. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

7. Third-party tools

Some features are supplied by third-party providers and may be subject to their terms. We do not control independent third-party services. Please review the relevant terms before using them. Nothing in this section excludes our responsibility for obligations we owe you under applicable law.

8. Third-party links

Our store may link to independent websites. Their content and transactions are governed by their own terms and policies. We do not endorse every linked website or accept responsibility for matters outside our control, subject always to applicable law and our own obligations.

9. Relationship with Shopify

Byron Seven is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver the Services. Section 10 explains how Shopify uses and processes information from these interactions. However, any sales and purchases you make in our Store are made directly with Byron Seven. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Byron Seven, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Byron Seven.

10. Privacy policy

Our privacy policy explains how we may collect, use, and disclose certain personal information from your use of the Services. By using the Services, you acknowledge that you have read this privacy policy. Because the Services are hosted by Shopify, as you browse and interact with the Services, Shopify collects, uses, processes, and stores personal information about your access to and use of the Services, including information about your transaction. Shopify may use this information for purposes including but not limited to providing, securing, and improving the Services; processing transactions; and helping prevent fraud on this website and on other websites that are powered by Shopify. Information collected when you visit or use the Services, including information collected automatically about your browsing activity, will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy and Shopify’s privacy policy for more details on how we, Shopify, and our partners use your personal information.

11. Reviews and feedback

You retain ownership of reviews and feedback you submit. You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, display and format that content to operate and promote our store and products, subject to applicable privacy and consumer law. We will not knowingly alter the meaning of a review or present it misleadingly.

Only submit material you are entitled to share, disclose any incentives received, and do not include unlawful material or others’ confidential information. We may remove spam, unlawful content or content infringing others’ rights. We do not promise payment or a response for unsolicited suggestions. Private customer-service correspondence is not treated as a public testimonial without permission.

12. Errors and availability

We may correct inaccurate listing information, including obvious pricing or availability errors. If an error affects your order, we will contact you to explain and, where appropriate, offer you the choice of proceeding on corrected terms or receiving a refund. We will not increase an accepted order’s price without your agreement. If we cannot fulfil an order, we will notify you and promptly refund the affected items.

13. Prohibited uses

13.1 You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with the these Terms of Service; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Byron Seven, Shopify or users of the Services, or expose them to liability.

13.2 In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated means to access the Services without authorisation, subject to section 14; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

14. Agents

14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

14.4 Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (b) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (i) mimicking human behavior and interaction patterns, or (ii) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (c) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (d) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

15. Suspension and termination

We may reasonably restrict access to protect the store against fraud, unlawful activity or material breaches of these Terms. Where appropriate, we will provide notice and an opportunity to address the issue. Restrictions do not remove rights relating to existing purchases, refunds or statutory remedies. Provisions intended to continue, including intellectual property, privacy and applicable liability provisions, survive termination.

16. Returns, defects and statutory guarantees

We do not offer an additional voluntary commercial warranty unless a product page expressly states otherwise. All statutory rights and remedies concerning product quality, fitness for purpose, description, defects and delivery remain available for the periods required by applicable law.

For eligible change-of-mind returns, notify us within 14 days after delivery. Where UK or EU statutory withdrawal rights apply, you may inspect the goods as you reasonably would in a shop; handling beyond what is necessary to establish their nature, characteristics and functioning may result in a lawful deduction for diminished value. Original packaging is helpful but is not an absolute condition of statutory rights.

Contact customerservice@byronseven.com for return instructions. For statutory withdrawals, notification does not require our approval, and applicable return deadlines remain in force. Where required, return goods within 14 days after notifying us of withdrawal.

You pay the direct return shipping costs for a change of mind where this was disclosed before purchase. We cover reasonable necessary return costs for faulty, damaged or incorrect goods where required by law. Return destinations vary according to your location and available facilities and may be in another country. Any material international-return requirements and applicable cost information must be disclosed before purchase; we will not impose undisclosed return burdens contrary to law. Contact us before sending goods. Our registered office is not a designated returns warehouse.

For statutory withdrawals, refunds include any legally refundable standard outbound delivery charge and are made within the applicable legal deadline, generally 14 days after notification. Where permitted, we may withhold the refund until we receive the goods or evidence of their return, whichever occurs first. Refunds use the original payment method unless otherwise agreed, without a refund processing fee. Bank posting times may vary.

Exceptions to withdrawal apply only where permitted by law, such as goods genuinely made to your specifications or clearly personalised. Standard made-on-demand goods, preorders and discounted goods are not automatically excluded. Digital-content withdrawal rights cease only where the legally required consent and acknowledgement have been obtained. Defective-goods rights remain unaffected.

Please report problems promptly, providing your order details and a description. We may request reasonable photographs, video or inspection to assess a claim. A video is not an automatic condition of statutory remedies, and we will consider reasonable alternative evidence. Deliberately falsified evidence may be rejected, but genuine claims and legal rights remain unaffected. Our Return and Refund Policy provides additional procedural information; these Terms and mandatory law prevail over inconsistent restrictions in that policy.

17. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

For consumers, we remain responsible for loss or damage that is a foreseeable result of our breach of contract or failure to exercise reasonable care and skill. We do not exclude the statutory rights and remedies attached to goods or shift responsibility for our own breach to you.

To the extent permitted by law, we are not responsible for damage caused solely by misuse, unauthorised modification or failure to follow reasonable instructions, rather than a defect or breach attributable to us. Any exclusion of indirect losses applies only where lawful. Business customers’ claims are governed by applicable law; these Terms do not impose a blanket exclusion of liability for all purchased products.

18. Your responsibilities

You are responsible for your own unlawful conduct and for content you submit in breach of others’ rights. These Terms do not require consumers to indemnify us for our own negligence, ordinary use of the store, or losses that applicable law places on us. Any recovery of losses or legal costs must have a lawful basis.

19. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. Nothing in these Terms limits any rights you may have under applicable consumer protection laws or other laws that cannot be waived by contract. If any part of these Terms conflicts with those rights, those rights will apply.

20. Waiver; entire agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguity will be interpreted in accordance with applicable law, including mandatory consumer protections.

21. Assignment

We may transfer our rights and obligations to another organisation where lawful and without reducing your contractual or statutory protections. We will notify you where required. You may transfer your contractual rights where we agree or applicable law permits.

22. Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections applicable in your country of habitual residence. Courts of England and Wales may hear disputes, without restricting any right you have to bring proceedings in another competent court, including your local courts where applicable law permits.

23. Translations

Translations may be provided for convenience. The English version is the reference version, except where mandatory law requires otherwise. This does not restrict rights arising from information provided to you in another language or any right to use a language required by a competent court or applicable law.

24. Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

25. Electronic communications

By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically, including by email, in-account notice, or posting on the Services. These communications may relate to your orders, account, purchases, returns, these Terms of Service, or other Services-related matters. You are responsible for keeping your contact information current.

26. Changes to these Terms

We may update these Terms for future use of the store and future purchases. The version in effect when you place an order applies to that purchase, unless a change is required by law or you expressly agree otherwise. We will provide notice of material changes where required. The revision date is shown above.
